Title

AN ORDINANCE CONCERNING I-2 ZONE for the purpose of amending the requirements of the Zoning Ordinance for Waste materials separation and processing facility uses within the I-2 (Heavy Industrial) Zone in Prince George's County.

Background

Waste materials separation and processing facilities are generally permitted uses in the I-2 (Heavy Industrial) Zone.  However, notwithstanding a requirement that the use contain its operations within a wholly enclosed building, the noise associated with operations of the use continues to generate noise pollution extending well beyond the site boundaries of the property and this negatively impacts certain incompatible residential uses in the area of the use site.  Because there is no regulation in the Zoning Ordinance designating the hours that a Waste materials separation and processing facility use may operate, this bill imposes certain limits on the hours of operation for the use so as to protect the public safety, health, and welfare of County residents, existing residential uses, and residentially-zoned land in close proximity to sites in the I-2 Zone where a Waste materials separation and processing facility may be located.
