Title

AN ACT CONCERNING THE LABOR CODE for the purpose of amending provisions of the Labor Code to eliminate the Public Employees Board and provide for a new system of arbitration selection under the Labor Code.

Background

This legislation will amend the Labor Code to provide for a new system of arbitration selection for disputes that arise under Subtitle 13A of the Prince George’s County Code.  Additionally, the legislation would eliminate the Public Employees Relations Board (“PERB”) and utilize the new system of arbitration selection.

 

In its current form, the Labor Code established the PERB for resolving disputes that arise between employers and collective bargaining groups.   However, in 2014, the Maryland Office of the Attorney General (OAG) issued two opinions that directly impacted the PERB by limiting the ability of members to serve on the board.  Therefore, adopting a new system of selecting arbitrators would eliminate the issue of members’ ability to serve on the PERB while still providing a fair system for the parties to resolve disputes.
