Title

A RESOLUTION CONCERNING THE SCHOOL FACILITIES SURCHARGE for the purpose of clarifying, without substantive change, the definition of County Urban Centers and Corridors to ensure consistency with current County center designations approved in the 2014 General Plan for the County, Plan Prince George’s 2035, to meet qualifying statutory criteria required for an exemption from payment of the School Facilities Surcharge enacted by the Maryland General Assembly for certain multifamily dwelling units that are studio apartments or efficiency apartments.

 

Background

In 2013, the Maryland General Assembly enacted Chapter 685, which reduced or waived the School Facilities Surcharge for certain multifamily residential development in the County for a temporary time period to expire on September 30, 2018.  As enacted by the State legislature, the set forth certain criteria for the reduction or exemption based on terms used in the General Plan in effect at the time of its enactment, the 2002 Prince George’s County General Plan.  In 2014, the County Council approved a new countywide general plan, Plan Prince George’s 2035, which amended certain policy terms set forth in the 2002 plan.  The Council has introduced clarifying legislation to ensure that the School Facilities Surcharge provisions of the County Code are consistent with the State law that remains in effect.  In the interest of maintaining continuity and viability of economic development in targeted development areas of the County and help realize the policies approved in the 2014 General Plan.  Pursuant to Section 1017 of the County Charter, this Resolution will temporarily clarify the continued efficacy of Ch. 685.
