Title

AN ORDINANCE CONCERNING COMMERCIAL ZONES - DAY CARE CENTERS FOR CHILDREN for the purpose of prohibiting day care centers for children in the C-S-C Zone, and providing for amortization by July 1, 2018.

 

Background

In commercial zones, day care centers for children are permitted subject to Detailed Site Plan approval.  The purposes of the C-S-C (Commercial Shopping Center) Zone are to provide locations for predominantly retail commercial shopping facilities, locations for compatible institutional, recreational, and service uses, and to exclude uses incompatible with general retail shopping centers and institutions.

The requirements for day care centers subject to Detailed Site Plan provide for outdoor play area, setbacks, screening, shade, and lighting.  Recent reviews have indicated that these requirements are not always sufficient in ensuring the health, safety and welfare of children especially in shopping center locations.  This legislation amends the Zoning Ordinance to prohibit day care centers for children in the C-S-C Zone.
