Title

A RESOLUTION CONCERNING WATERSHED PROTECTION AND RESTORATION for the purpose of Prince George's County's Watershed Protection and Restoration Financial Assurance Plan (FAP) for approving the Prince George's County Financial Assurance as required by State law.

 

Background

The Environment Article of Annotated Code of Maryland, Section 4-202.1, mandates that jurisdictions that are subject to a National Pollutant Discharge Elimination System (NPDES) Phase I MS4 permit must submit a Financial Assurance Plan to the Maryland Department of the Environment (MDE) every two years on the anniversary of the date of permit issuance. The purpose of the plan is to demonstrate that the jurisdiction has the funding capacity necessary to fulfill the watershed protection and restoration requirements in accordance with the NPDES permit.

 

State law requires that the financial assurance plan be approved by the local governing body after public hearing.
