Title

A RESOLUTION CONCERNING TEMPORARY MORATORIUM ON CORRECTIONS FACILITIES AND PRISONS for the purpose of establishing a one (1) year moratorium on the issuance of building permits or certificates of occupancy for corrections facilities or prisons in Council District 4.

Background

This resolution will establish a one (1) year moratorium on the issuance of building permits or certificates of occupancy for corrections facilities and prisons in Council District 4. Currently, Section 4-345(o) the County Code defines “detention center” and prohibits the issuance of a building permit or certificate of occupancy for any detention center but is silent as to corrections facilities and prisons. The Zoning Ordinance provides that prison, detention center, and corrections facility uses, unless owned or operated by Prince George’s County, are prohibited in all zones, but does not contain definitions for those uses. By establishing this temporary moratorium, the County Council will have time to consider how best to address concerns about siting facilities that are part of the carceral criminal justice system.
