An Act concerning Notice to Purchasers of Real Estate in Special Taxing Districts for the purpose of amending the Consumer Protection laws of the County to require disclosure in residential real estate contracts that the subject property is subject to additional taxes and fees in a Special Taxing District and to provide provisions for the failure to provide the required notice.
Background
Some residential subdivisions have been approved under the County Code §10-269 to be within Special Taxing Districts, which require the payment of additional taxes to pay off bonds issued for infrastructure improvements in the subdivision. Individual property owners who purchase residential lots with Special Taxing Districts are often unaware of the existence of additional taxes and fees. Failure to make the required payments can result in fines, penalties, liens and possible sale of the property. The proposed legislation would require a seller of property within a Special Taxing District to give written notice at the time of contracting for the sale of the property to the purchaser and provide penalties for failure to provide the required notice.
