A resolution for the purpose of amending the program regulations for the Purchase of Development Rights Program.
Background
The purpose of this resolution is to amend the program regulations for the Purchase of Development Rights Program (“PDR”) pursuant to Section 30-306(b) (1) of the Prince George’s County Code. This resolution updates the regulations to include points for properties located in the newly designated Priority Preservation Area (PPA), as identified in County Council approved Subregions 1, 5, and 6 master plans and the pending Priority Preservation Area Functional Master Plan.
This resolution also includes points for properties located in the designated Green Infrastructure Network of the County Council approved Countywide Green Infrastructure Plan. This amendment will implement the purpose of the Purchase of Development Rights Program as stated in CB-047-2006 in Section 30.303 (a) of the Prince George’s County Code. Lastly, the resolution proposes an amendment to include county Scenic or Historic Roads that were designated in the County Council approved Master Plan of Transportation.
This resolution will also bring the county into compliance with the requirements of House Bill 2, the Agricultural Stewardship Act of 2006. The bill was signed by Governor O’Malley on Friday, May 5, 2006. The Agricultural Stewardship Act of 2006 amended Title 5, Subtitle 4 of the State Finance and Procurement Article of the Annotated Code of Maryland to require local jurisdictions to include priority preservation areas for certification of local preservation programs.
CR-82-2006 not only provides the ranking criteria for the county’s PDR Program, but also for the Commission’s Historic Agricultural Resource Preservation (HARPP) Program. Including the PPA status in the PDR and HARPP programs will help the county to move closer to certification and retaining seventy-five percent (75%) of the Prince George’s County Agricultural Transfer Tax Revenue, instead of the current thirty-three percent (33%) level.
