Title

AN ACT CONCERNING SCHOOL FACILITIES SURCHARGE for the purpose of clarifying the manner of local appropriation for funds received by the County pursuant to the School Facilities surcharge imposed upon certain new residential construction, in furtherance of the public safety, health, and welfare of the citizens and residents of Prince George’s County.

 

Background

In 1997, the Maryland General Assembly enacted Chapter 66, thereby establishing County authority to impose a surcharge on certain residential construction in the County in order to help mitigate its impact on the public school system, and it is codified in the public local laws of the County at Section 10-192.01 of the County Code.  While the authority set forth in Section 10-192.01 provides requirements as to the types of projects eligible for use of the funds received pursuant to the surcharge, the manner of local appropriation is not specific to any geopgraphic area that is most likely to be directly impacted by the residential development that generate the surcharge funds. Thus, and in further effort to better the public health and welfare of the citizens and residents of the County, this bill will clarify the manner of local appropriation for funds paid pursuant to the County's School Facilities Surcharge imposed upon residential development in the County.
