A RESOLUTION CONCERNING THE ENACTMENT OF CERTAIN ORDINANCE OF THE CITY OF COLLEGE PARK for the purpose of approving the enactment of City Ordinance 23-O-02, amending Chapter 190, Article I, in order to align municipal provisions concerning departures and variances with the Prince George’s County Zoning Ordinance in effect as of April 1, 2022.
Background
Section 25-301, Land Use Article, Maryland Annotated Code, authorizes the District Council to confer the exercise of certain powers of the District Council upon the governing body of a municipal corporation within the Prince George's County portion of the Maryland-Washington Regional District. Accordingly, Section 27-3308 of the County Zoning Ordinance provides authority for the governing body of County municipal corporations to legislate on certain subjects, including residential parking and loading, departures from local parking and loading, landscaping requirements, sign design standards, variances for setbacks and lot area regulations, as well as nonconforming use regulations and fence regulations for the area within its municipal boundaries, while making appropriate references to County law which remain applicable within the municipal boundaries. In accordance with this procedures, the municipal corporation must duly enact and submit its Ordinance to the District Council for review and approval in order for the municipal law to take effect. This Resolution will approve the enactment of a certain Ordinance by the City of College Park, which amends Chapter 190, Article I of the City Code to conform municipal provisions related to departures and variances to those set forth in the new County Zoning Ordinance which took effect on April 1, 2022.
