AN ORDINANCE CONCERNING USE REGULATIONS - DAY CARE CENTERS FOR CHILDREN for the purpose of increasing access to childcare facilities by eliminating special exception approval for day care centers for children in all zones; exempting day care centers for children from detailed site plan approval; providing for community notification of proposed day care centers; removing minimum parking requirements in all transit-oriented zones; reducing minimum parking requirements in certain activity zones; and providing for alternative parking compliance in all other zones.

 

Background

This bill seeks to increase the number of childcare facilities in Prince George's County by relaxing certain zoning requirements for child day care centers. Specifically, the bill permits day care centers for children by right in all zones in which currently require special exception approval. Additionally, day care centers would be exempt from the requirements of detailed site plan approval, deferring site plan review until the building permit stage. While pre-application neighborhood meetings will no longer be required, day care center providers must post notice of the permit application within 30 days of filing. Finally, the bill reduces minimum parking standards in three ways. First, minimum parking requires in the edge portion of transit-oriented zones will be eliminated. Parking requirements in the edge portion of Town Activity Center zones are reduced in this bill to match the level required in the core areas of those zones (1 space per 20 children). Finally, the bill allows parking requirements to be met with on-street spaces abutting the day care center, mirroring the incentive offered by neighboring Montgomery County.
