Title

A RESOLUTION CONCERNING THE ENACTMENT OF CERTAIN ORDINANCE OF THE CITY OF BOWIE for the purpose of approving the enactment of City Ordinance O-3-23, amending Chapter 26, Article I, Section 26-2 “Fences,” in order to amend certain definitions and regulations concerning fences in the City Code; and to implement, incorporate, and reference the Prince George’s County Zoning Ordinance and County Subdivision Regulations in effect as of April 1, 2022. 

 

Background

Section 25-301, Land Use Article, Maryland Annotated Code, authorizes the District Council to confer the exercise of certain powers of the District Council upon the governing body of a municipal corporation within the Maryland-Washington Metropolitan District. Accordingly, Section 27-3308 of the County Zoning Ordinance provides authority for the governing body of County municipal corporations to legislate on certain subjects, including residential parking and loading, departures from certain development regulations, signage, nonconforming uses, and fences, while making appropriate references to County law which remain in full force and effect within the municipal boundaries. In accordance with this procedure, the municipal corporation must duly enact and submit its Ordinance to the District Council for review and approval in order for the municipal law to take effect. This Resolution will approve the enactment of a certain Ordinance by the City of Bowie, which updates certain references to Subtitles 24 and 27 of the Prince George's County Code, and amends certain definitions and regulations concerning the erection of fences on corner lots within the corporate boundaries of the City of Bowie.
