AN ACT CONCERNING UNTRACEABLE FIREARMS AND MINORS for the purpose of prohibiting the transfer of untraceable firearms to minors; and increasing the maximum penalty for each violation; and other general provisions related to untraceable firearms.
Background
In 2022, the Maryland General Assembly enacted Md. Public Safety Code Ann Title 5, Subtitle 7 Untraceable Firearms. This new subtitle defines the type of weapon commonly referred to as "ghost guns" and prohibits the manufacturing, transferring, or sale of such weapons. In addition to prohibiting these weapons, the State also conveyed authority to the Secretary of Police to adopt regulations have been published directing local jurisdictions how to enforce the ban on ghost guns. This legislation will add the State's definition of untraceable firearms to the list of prohibited weapons in regards to minors. It will also increase the fine for violating this act to the maximum amount permitted under State law.
In addition, this bill adds untraceable firearms to the list of prohibited loaded weapons that may not be carried, worn, or transported within a certain threshold of specific locations. It is important to note that this bill only prohibits the discharge of weapons or the wear, carry, or transport of loaded weapons by persons who do not qualify under the exceptions to wit: those with a valid State issued wear and carry permit.
