Title
A RESOLUTION CONCERNING THE COUNTYWIDE SECTIONAL MAP AMENDMENT for the purpose of approving, as a legislative enactment of the District Council having the force and effect of law, an amendment to clarify and extend the time for public comment and other record testimony for consideration within the Countywide Sectional Map Amendment procedures.
Background
Pursuant to the provisions of Title 22, Land Use Article, and Title 10, Local Government Article, Annotated Code of Maryland, the Maryland General Assembly conferred certain legislative prerogatives upon the Prince George's County Council: (1) for approval of local zoning laws regulating the uses and classes of zones sitting as the District Council for that portion of the Maryland-Washington Regional District within Prince George's County, Maryland; and (2) as a political subdivision of the State with a Charter/Home Rule form of local government per Article XI-A, Maryland Constitution, and the Express Powers Act, Title 10, Local Government Article, Annotated Code of Maryland, to enact regulations in furtherance of the public safety, health, and welfare of the citizens and residents of the County.
As such, Section 1017 of the County Charter provides that the Council may adopt legislative provisions with the force and effect of law, but of a temporary or administrative character. The Council seeks to clarify its intent to seek robust public comment and other testimony in consideration of a Countywide Sectional Map Amendment process. Accordingly, this Resolution shall serve as a temporary reprieve from the 60-day public request period during the CMA process.
This temporary measure is a companion legislative enactment to a correspondent, codified Council Bill for this purpose.
