A RESOLUTION CONCERNING MAJOR PUBLIC PRIVATE PARTNERSHIP AGREEMENTS - URGING ADDITIONAL OVERSIGHT for the purpose of urging the Board of Public Works to ensure that contracts with a total value that exceeds $500 million, meet certain standards and benchmarks.

 

Background

House Bill 1091 of the 2019 Legislative Session would have changed the process for the approval of public-private partnerships (P3s) which are valued at more than $500 million. It would have expanded the prohibition against noncompete clauses for P3 road and bridge projects to include noncompete clauses that may impede any transit project or road maintenance projects, such as toll lanes on I-495. The bill stalled in the Senate. This Resolution encourages the Board of Public Works to carefully review P3 agreements on similar projects to ensure that any P3 project to build toll lanes on I-495 is thoroughly researched and properly executed before it is approved.
