This bill would define the use, “Sustainable Inclusive Mixed-Use Community’ in the Zoning Ordinance; permitting the use in the RE (Residential Estate) zone of the County pursuant to the grant of a special exception and establishing regulations applicable to said special exception.

Special Instructions/Concerns/Time Critical Information:

I am attaching the original draft text amendment which was previously proposed with Mr. Gibbs with former CM Watson. I was made aware from Mr. Gibbs that when Park and Planning reviewed the original draft, they commented that the draft could be viewed as too general and would possibly allow the text amendment to be used generally by too many applicants. Mr. Gibb believe that is not the case. However, we are providing a revised draft which further restricts the definition of a “Sustainable Inclusive Mixed-Use Community”. Proposed changes are shown in red on pages 2 and 3 of the revised draft. The draft revisions do not alter the inherent nature of the use, but they do further refine the nature of the agricultural component to address the comments raised by staff. Perhaps the drafter can use the revised draft if they agree it further restricts the nature of the use in a beneficial manner.
