Background Necessitating Legislation:
The current enforcement process is confusing and not aligned across the ordinance. While the prohibition is already in the Zoning Ordinance, the problem is typically enforcement capacity, evidentiary standards, and penalty severity. This draft attempts to: create a specific "nuisance" classification for repeated violations; increase fine schedules and making them progressive per offense; clarify evidentiary standards; and enhance the ability to impose liens or suspend other permits/licenses for violators and streamline the process for abatement.
This framework ensures that even the most defiant illegal operator faces consequences that ultimately threaten their ability to use the property at all, which is the only effective remedy for the most stubborn cases. The amendments create the necessary legal "hooks" between the three code sections to make this escalation automatic and enforceable.
