Title

AN ACT CONCERNING ADMINISTRATIVE HEARINGS for the purpose of establishing the provisions for administrative hearings.

 

Background

The purpose of this Bill is to create a streamlined process for Code enforcement violations.  The Bill would add Division 15 to Subtitle 13 of the County Code.  Division 15 would establish provisions for the administrative hearing board.  This Bill, modeled after Baltimore City’s Environmental Control Board, is intended to reduce the District Court docket and send the minor property standard violation through the Administrative Hearing Board.  Currently, the process takes in excess of nine months to get to an adjudication in Court.  Here, the administrative hearing board would hear the minor property cases within ninety days.

 

11/7/2017:  CB-64-2017 (DR-2) was amended on the floor; CB-64-2017 (DR-3) was enacted.  The amendments to CB-64-2017 (DR-2) are technical and non-substantive.  The purpose of the amendments is to place CB-64-2017 (DR-2) into proper legislative form.  As adopted in the Transportation, Housing and the Environment (THE) Committee, (DR-2) was amended.  All language to be added was added and all language to be stricken was stricken.  However, this was not correctly reflected in DR-2 until amended.  CB-64-2017 (DR-3) incorporates all of the necessary corrections.
