A RESOLUTION CONCERNING MARYLAND-NATIONAL CAPITAL PARK AND PLANNING COMMISSION for the purpose of approving certain transfers of appropriations within the Approved FY 2022-2023 Operating Budget of the Maryland-National Capital Park and Planning Commission to the Approved Fiscal Year 2023-2028 Capital Improvement Program of the Maryland-National Capital Park and Planning Commission.
Background
In accordance with Title 18 of the Land Use Article, Annotated Code of Maryland, the Prince George’s County Council may approve amendments to the operating budget of the Maryland-National Capital Park and Planning Commission (“M-NCPPC”). This Resolution will approve certain amendments to the current Operating Budget of the Prince George’s County portion of the Maryland-National Capital Park and Planning Commission. On June 1, 2022, via enactment of CB-055-2022, the Prince George’s County Council approved the annual M-NCPPC Operating Budget for that portion of the Maryland-Washington Regional District within Prince George’s County. Included within the approved operating budget was an Appendix B, which provided specific appropriations to the Recreation Fund portion of the FY 2022-2023 Operating Budget. Specifically, an approved appropriation was made to “support athletic facility partnerships between the Commission and PGCPS and/or various boys and girls clubs” in the amount of $35 million, with further direction to be provided by the Council as to the use of these dedicated funds within the fiscal year. Accordingly, this Resolution will amend the Approved Fiscal Year 2022-2023 Operating Budget of the Maryland-National Capital Park and Planning Commission (CB-055-2022), in order to transfer appropriations to certain capital projects within the Approved Fiscal Year 2023-2028 Capital Improvement Program Budget of the Commission.
Additional Background and Procedural Note:
On September 27, 2022, the Council convened as the Committee of the Whole to examine and develop methods to amplify its direction to support athletic facility partnerships between the Commission and PGCPS and/or various boys and girls clubs in the County, as set forth in CB-55-2022, the Approved Annual Operating and Capital Budget for the Maryland-National Capital Park and Planning Commission (M-NCPPC). After discussion, the Committee voted to direct its Staff to prepare a Resolution to propose amendments to the Approved FY 2022-2023 Maryland-National Capital Park and Planning Commission Approved Annual 2022-2023 Operating and 2023-2028 Capital Improvement Program Budgets to transfer appropriations from the Operating Budget to identified Capital Projects. The identified Capital Projects are reflected in the Resolution.
In addition, the Committee determined that while legislative action is appropriate to amend the approved M-NCPPC budget to address specific funding for identified Capital Projects, a companion Council action item in the form of Proposed Correspondence to the Maryland-National Capital Park and Planning Commission is also needed to refine its direction as to Operating Budget appropriations to the Recreation Fund within the approved current Fiscal Year. As such, the Committee further voted to direct its Staff to prepare Proposed Correspondence to the Director of the Department of Parks and Recreation to transmit a list of prioritized programs and projects designated for support through current Fiscal Year funding.
During the September 27, 2022, legislative session-day of the County Council, and prior to the Council’s action to Introduce CR-119-2022, the list of designees was amended on the Council Floor upon unanimous Favorable Motion by Council Member Taveras. Because these amendments to the list of designees for approved Operating Fund appropriations have no direct effect on the legislative amendment to transfer appropriations to the named Capital Projects within CR-119-2022, the Amendment has no legislative effect on CR-119-2022.
