(SUBDIVISION BILL) - AN ACT CONCERNING PRIVATE ROADS AND EASEMENTS for the purpose of permitting the Planning Board to approve private roads and alleys in the C-M (Commercial Miscellaneous), C-S-C (Commercial Shopping Center), C-O (Commercial Office), I-3 (Planned Industrial/Employment Park), R-55 (One-Family Detached Residential), R-R (Rural Residential), and R-T (Residential Townhouse) Zones of Prince George’s County, under certain specified circumstances.
Background
This bill amends the County Subdivision Regulations to expand the authority of the Planning Board to approve applications for preliminary plans of subdivision that employ private roads and alleys of a certain minimum size in various zones of the County, subject to review by the County Fire Chief to ensure and/or promote the health, safety, and welfare of County citizens and residents.
A substantially similar piece of legislation, CB-005-2018, preceded this legislative proposal and was enacted by the County Council on April 17, 2018, but did not take effect. This bill will supplant the prior enactment of CB-005-2018 by the County Council.
