Title

AN ACT CONCERNING CANNABIS REINVESTMENT AND RESTORATION BOARD for the purpose of creating the Cannabis Reinvestment and Restoration Board; providing for the purpose, membership, terms and compensation of members, appointment of a chair, meeting standards, and duties of Cannabis Reinvestment and Restoration Board; establishing the Community Reinvestment and Repair Special Revenue Fund for the purpose of receiving funds from the State Community Reinvestment and Repair Fund; providing that the Fund shall be a special, non-lapsing fund; establishing the purpose of the Fund; and generally relating to the Cannabis Reinvestment and Reparations Board.

 

Background

The State has allowed recreational use cannabis and has imposed sales and use tax on cannabis of 9% pursuant to § 11-104 of the Tax General Article of the Maryland Code, which prescribes the distribution of that tax revenues. This sales and use tax collected is first applied to defray the entire cost of the operations and expenses of the Maryland Cannabis Administration with 35% being distributed to the State’s Community Reinvestment and Repair Fund, 5% is distributed to counties based on the revenue collected from each county, 5% is distributed to the State’s Cannabis Public Health Fund, 5% is distributed to the State’s Cannabis Business Assistance Fund, and the balance is distributed to the State’s general fund. Each county is charged with promulgating laws on how it will distribute the monies it receives from the sales and use tax generated from the sale of cannabis.
